By accessing or using NexoDine's website and services ("Services"), you agree to be bound by these Terms of Service. If you do not agree, do not use our Services.
NexoDine provides AI-powered digital employee solutions for independent restaurants, including zero-commission online ordering systems, AI marketing agents, and reputation management tools. Services are provided on a subscription basis as agreed in your service agreement.
You must be at least 18 years old and have the legal authority to bind yourself or your business to these terms. By using our Services, you represent that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
Subscription fees are billed monthly in advance. All fees are non-refundable except as provided in our 60-day guarantee or as required by law. We reserve the right to change pricing with 30 days' notice.
If our Revenue Engine does not generate its cost in new commission-free orders within your first 60 days of active use, you may request a full refund. This guarantee applies to the Revenue Engine product only and requires good-faith implementation of our recommendations.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No long-term contracts are required unless otherwise agreed in writing.
All content, software, and technology comprising NexoDine's Services are owned by or licensed to NexoDine and protected by intellectual property laws. You retain ownership of your business data, customer information, and content you provide.
Your customer data (names, emails, phone numbers, order history) belongs to you. We process this data on your behalf to provide Services. Upon cancellation, we will provide an export of your data within 30 days of request.
To the maximum extent permitted by law, NexoDine's total liability for any claims arising from these Terms or your use of Services shall not exceed the total fees paid by you in the 12 months preceding the claim. NexoDine is not liable for indirect, incidental, special, or consequential damages.
Services are provided "as is" and "as available." We do not guarantee specific results, including revenue increases, review improvements, or order volumes. Results vary based on location, market conditions, and implementation.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Miami-Dade County, Florida.
We may modify these Terms at any time. Material changes will be communicated via email or prominent notice on our website at least 30 days before taking effect. Continued use after changes constitutes acceptance.
